IDA drops zoning immunity fight

The Effingham Industrial Development Authority won’t continue the fight to get immunity from local zoning laws.

The state court of appeals ruled the Effingham County Superior Court’s finding that the IDA was immune from zoning regulations was an advisory opinion and had to be vacated. IDA board members have voted not to appeal the decision to the Supreme Court.

“I was glad to see the situation was resolved in a reasonable manner,” IDA Chief Executive Officer John Henry said.

The IDA originally sought the ruling in April 2006 for what is becoming the LogistiCenter industrial park being developed by DP Partners. The I-1 zoning for it was granted earlier this year by county commissioners.

The General Assembly passed House Bill 543 earlier this year, making the IDA subject to county zoning laws..
